Native American Miners Owed Workers Comp
For several decades, American Indians have been the primary workers in mines that are located deep under the Colorado Plateau. In order to obtain the soft, yellow uranium ore present, they must operate a drill that plunges deep into the rock. This same uranium which was mined by countless American Indian workers was used inside of nuclear weapons, which were responsible for America’s eventual victory during the Cold War. When you would like to get more information on personal injury lawyers check out this site.
But the Cold War has now claimed many of these miners as casualties. They are either dead or drying from cancer and other ailments blamed on exposure to radiation in the mines. So many people have lost members of their families, and even many who survived are still fighting for their lives.
Heavily scarred arms from dialysis treatments is common among the survivors of the radiation. The dialysis is the only available treatment for those who suffer from kidney failure. The drinking water provided to the miners has been tested and proven to contain traces of radioactive minerals which many blame for the kidney failure.
Congress passed the Radiation Exposure Compensation Act in 1990. This law recognized the dangers that were faced by uranium miners, and was designed to help those who have suffered and continue to suffer due to the work they performed. This mining was undertaken strictly for the advancement of the American nuclear weapons program. You will find that further information on workers compensation lawyer melbourne is on that site.
The law provides $100,000 to each underground uranium miner. The criteria for receiving this compensation is that the miner must experience at least one out of the six lung diseases that stem from exposure to radiation. Countless miners of American Indian descent still have not been compensated, despite being eligible.
The act, as it was written, forces these miners to face conditions that are almost impossible to meet. Firstly, the paperwork is all in English. However, there are many Native Americans who do not speak or write English.
Astoundingly, only 96 miners who have filed compensation claims through the Office of Navajo Uranium Workers have been approved, even though 242 miners have applied. The total number of claims filed by former uranium miners approved by the Justice Department is 1,314. Unfortunately, over 1300 applications for compensation have also been denied.
The required records to prove that one actually worked in a uranium mine include paycheck stubs, as well as other forms of documentation. But many of those who have worked the mines, even for many years, didn’t keep these records. Furthermore, these are difficult to obtain through authorities.
The United States government first opened up the uranium minds on the Navajo Indian Reservation back in 1947. The mines were welcomed by the people in the area because they brought jobs and income to the area. Regardless of the deprived conditions present and low compensation provided, the American Indians were eager to provide the work.
One of the biggest dangers in the mines is radon. Radon is created by the decay of uranium and is a colourless, odourless radioactive gas. Exposure to radon is believed to be a cause of most of the lung ailments that make miners eligible for government compensation.
In order to facilitate the process of receiving compensation for their injuries, past miners and tribal leaders plan to petition Congress for modification of the bill in the fall. The government’s biggest concern is that many miners feel that they deserve compensation simply because they worked in the mines, rather than due to the illness and disease they acquired as a result of that work.
