Workers Compensation Is The Right Of American Indian Miners
American Indians have been working in mines deep below the Colorado Plateau for decades. Soft, yellow uranium ore was drilled from the rock by the miners. However, many of the miners themselves have become Cold War casualties. Radiation in the uranium mines has caused the miners a variety of health problems, such as cancer and other illnesses caused by exposure; many have even died. In 1990, the Radiation Exposure Compensation Act was ratified by Congress. This law recognized the dangers that were faced by uranium miners, and was designed to help those who have suffered and continue to suffer due to the work they performed. The reason these miners are being compensated by taxpayers is that the work they did was solely to assist the American military’s nuclear weapons division. Every uranium miner is entitled to $100,000. The only condition required was that they should have been diagnosed with one of six possible lung diseases that are linked to radiation exposure. However, of the hundreds of Native Indian miners who are eligible to receive this payment, not one of them as seen a penny of it to this day.
The miners have found that filing a claim is almost impossible because of many of the requirements of the statute. One of the first, and hardest for them, is the requirement to fill out paperwork that’s written in English. However, many of the Indian miners are illiterate in English and find the forms confusing.
There have been 242 miners who applied through the Office of Navajo Uranium Workers for their compensation, but to date only 96 of them have received approval. The Justice Department has approved a total of 1,314 claims of former uranium miners suffering from health problems. Another 1,316 miners’ applications have been denied.
In order to establish how much time the miner labored in the mines, Congress demands check stubs and other documents in order for the miners to prove their claims. Those who have been working in the mines for decades don’t tend to keep these records. Copies of such records are difficult to obtain.
In 1947, the first uranium mines were started on and near the Navajo Indian Reservation. During this period, the Navajo were glad to see an opportunity for employment. People were happy to have the work despite the low wages and harsh conditions.
At that time radon was one of the greatest dangers in those mines. This colourless, odourless radioactive gas occurred as uranium decayed. Experts believe that it is this exposure to radon that leads to many of the lung problems that the government has placed on the compensation list.
This fall tribal officials along with former miners will actively and strongly encourage Congress to make the changes necessary to allow these other miners to receive their payments. Many Navajo miners think that compensation is due based simply on their having worked the mines; this is another problem with the Act being misunderstood and needs clarification.
